1. The Service

Welcome to Ye Olde-Fashioned Bio Research Corporation! These Terms of Service ("Terms") govern your access to and use of our virtual 3D worlds ("Service"). By subscribing to and using our Service, you agree to be bound by these Terms.

Ye Olde-Fashioned Bio Research Corporation provides a monthly or annual subscription-based "passport" granting you access to explore a variety of virtual 3D worlds. This Service is for entertainment and exploration purposes only.

Limited License to User: Your "passport" (subscription) grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial entertainment purposes, strictly in accordance with these Terms. This license does not transfer any ownership rights or intellectual property interests in the Service or its underlying content to you.

Our Ownership: All rights, title, and interest in and to the Service, including all virtual worlds, content, software, graphics, text, logos, trademarks, and any other intellectual property created by Ye Olde-Fashioned Bio Research Corporation and comprising the Service, are and will remain the exclusive property of Ye Olde-Fashioned Bio Research Corporation and its licensors. You acknowledge that the Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

2. Service Modifications

We reserve the right to modify, update, suspend, or discontinue any aspect of the virtual worlds, features, content, or the Service itself, at any time, with or without prior notice to you. You agree that Ye Olde-Fashioned Bio Research Corporation will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service or any part thereof.

3. Subscription and Payments

• Subscription Basis: Your access to the Service is provided on a monthly or annual subscription basis.
• Payment Processing: All payments are processed securely through Stripe, a third-party payment processor. We don't directly collect or store your credit card information.
• Billing Cycle: Your subscription automatically renews each month or year, depending on your chosen plan. Your credit card will be charged on the same day of the month/year as your initial subscription, or the closest date if that day doesn't exist in a given month (e.g., if you subscribe on January 31st, your next charge date would be February 28th/29th).

4. Cancellations and Refunds

• Immediate Cancellations: You may cancel your subscription at any time. Your cancellation will be effective immediately, meaning your access to the virtual worlds will cease as soon as you cancel, regardless of any remaining time in your current monthly or annual billing cycle.
• No Refunds: Due to the immediate nature of service access and cancellation, we don't offer refunds for any partial monthly or annual periods or for any reason once a payment has been made.

5. Virtual Currency (Coins)

• Purchase of Coins: Users may purchase virtual currency ("Coins") through the Service.
• No Real-World Value: Coins are a virtual currency with no real-world value. They cannot be redeemed for real money, goods, or other items of monetary value from Ye Olde-Fashioned Bio Research Corporation or any other party. Coins exist solely within the Service and are for entertainment and in-world interaction purposes only.
• Account-Tied and Non-Transferable: Coins are tied exclusively to the user account from which they were purchased and cannot be transferred, sold, gifted, or otherwise exchanged to any other user account or person, whether within or outside the Service. Any attempted transfer is void and may result in account suspension or termination.
• No Refunds for Coins: All purchases of Coins are final and non-refundable. We do not offer refunds or exchanges for purchased Coins, for any reason, including but not limited to account suspension, termination, or loss of access to the Service.
• Forfeiture of Coins: We reserve the right to forfeit Coins, or upon the termination or suspension of your account, at our sole discretion and without liability to you.
• Modification of Coin System: We reserve the right to modify, add, or remove items for which Coins can be used, and to change the value or availability of Coins at any time, with or without notice, at our sole discretion.

6. No Personal Information Collection

We are committed to user privacy. We do not collect personal identifying information from our users within the Service. While we may collect anonymous technical data (such as general usage statistics or error logs) to maintain and improve the Service, this data cannot be used to identify you personally. Your payment information is handled solely by Stripe, as described in Section 3.

7. User Eligibility and Minor Use

The Service is intended for users who are at least 18 years of age. If you are a minor (under 18 years of age), you may only use the Service if your parent or legal guardian ("Parent") has established the account and agreed to these Terms on your behalf. The Parent whose name is on the Stripe subscription is the primary account holder and is solely responsible for:

• The online conduct of any minor using the Service through their account.
• Monitoring the minor's access to and use of the Service.
• The consequences of any use of the Service by the minor.
• Ensuring that the minor understands and complies with these Terms and any community guidelines we may publish.

By allowing a minor to use the Service through your account, you represent and warrant that you are the legal Parent of the minor and agree to be bound by these Terms on their behalf.

8. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Using the Service for any unlawful purpose or in violation of any applicable local, state, federal, or international law or regulation, including but not limited to engaging in fraudulent activities or distributing copyrighted material without permission.
• Engaging in any form of harmful or abusive behavior, including but not limited to harassment, bullying, hate speech, threats, intimidation, or discrimination.
• Impersonating any person or entity, including, but not limited to, a representative of Ye Olde-Fashioned Bio Research Corporation, another user, or a public figure.
• Engaging in any technical misuse of the Service, including:
  • Unauthorized access to any part of the Service, other users' accounts, or our computer systems.
  • Interfering with, disrupting, or damaging the operation of the Service or its servers.
  • Introducing or transmitting viruses, malware, worms, trojan horses, or any other destructive or harmful code.
  • Using scripts or any automated means to access or interact with the Service in a detrimental manner.
  • Exploiting bugs, glitches, or vulnerabilities in the Service to disrupt others.
• Posting, displaying, transmitting, or otherwise making available any content that is defamatory, libelous, or slanderous, or content that infringes on the intellectual property rights (including copyright, trademark, patent, trade secret, or other proprietary rights) of others.
• Violating any additional community guidelines, codes of conduct, or policies that we may publish from time to time, which are incorporated into these Terms by reference.

9. Developer Usage

Ye Olde-Fashioned Bio Research Corporation may provide Developer Resources (including custom API key solutions and documentation) to allow developers to create applications or features that interact with our Service. If you use Developer Resources, the following terms apply:

• Grant of Developer License: We grant you a limited, non-exclusive, non-transferable, revocable license to use our Developer Resources solely for the purpose of developing, testing, and distributing applications that integrate with our Service. This license does not grant you any ownership rights or intellectual property interests in the Developer Resources, our API, or the Service.
• API Keys and Security: Your API Keys are confidential. You are solely responsible for maintaining the security of your API Keys and for all activities that occur under them. Do not share or publicly expose your API Keys.
• Acceptable Use of API: Your use of the API must be fair and reasonable and not impose an unreasonable load on our systems. This includes adhering to any stated rate limits. All applications developed using our Developer Resources must comply with these Terms of Service, particularly the Prohibited Conduct section (Section 8). You may not use Developer Resources to circumvent our security measures, access data you are not authorized to access, or engage in any activity that could harm, disrupt, or interfere with the Service or other users.
• Disclaimer for Developer Apps: We are not responsible for the functionality, security, or content of any third-party applications developed using our Developer Resources. Users should review the terms and privacy policies of any third-party applications before using them.
• Termination of Developer License and Use of Service: We reserve the right to revoke any or all of your API keys and terminate your developer license, and consequently your ability to use the Service, at our sole discretion, particularly in cases of non-compliance with these Terms.

10. Your Responsibilities

You are responsible for maintaining the security of your account and for all activities that occur under it. You agree to use the Service lawfully and in accordance with these Terms, including the Prohibited Conduct outlined in Section 8.

11. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Service, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Service Availability: While we strive to provide continuous access, the Service may be unavailable from time to time due to maintenance, upgrades, unforeseen technical issues, or other factors. We do not guarantee continuous or uninterrupted availability of the Service.

12. Limitation of Liability

To the fullest extent permitted by law, Ye Olde-Fashioned Bio Research Corporation won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we'll notify you by posting the updated Terms on our website. Your continued use of the Service after such changes means you accept the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

15. Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
